Section 44-31 Faculty Legislative Representative and Deputy Faculty Legislative Representative
- In accordance with Chapter 21, Section 21-42 and Chapter 22, Section 22-34, the Senate will elect:
- A Faculty Legislative Representative (Legislative Representative); and
- A Deputy Faculty Legislative Representative (Deputy Representative).
- The Legislative Representative and the Deputy Representative will represent the faculty in all matters of state legislation affecting the University, and to the extent necessary, attend sessions of the state legislature and appear before legislative committees on behalf of the faculty.
-
- The Legislative Representative will be chosen from among the voting members of the faculty by a majority vote of the Senate each Winter Quarter.
- The Deputy Representative will be chosen from among the voting members of the faculty by a majority vote of the Senate in the Winter Quarter of even years. The Senate will elect a Deputy Representative in the Winter Quarter of odd years only if the Senate Executive Committee in the preceding Autumn Quarter determines that a Deputy Representative will be elected.
- The Senate Executive Committee will publish in the agenda for a regular Senate meeting the name of at least one nominee for Legislative Representative, and if authorized as per Subsection C.2, for the Deputy Representative. Additional nominations may be made from the floor. If three or more nominees for a position appear on the ballot, the election for that position will use a ranked choice voting system. If no nominee for a position receives a majority, all but the two highest will be eliminated, and a second ballot will be cast.
- The Legislative Representative and the Deputy Representative will each serve for a one-year term beginning on July 1 in the calendar year of election.
- If the position of the Legislative Representative or the Deputy Representative becomes vacant, a committee consisting of the Senate Chair, Vice Chair, and Immediate Past Chair will appoint a temporary replacement pending a prompt election of a successor to serve for the remainder of the unexpired term.
- The Legislative Representative and the Deputy Representative each may be removed from office during each respective term of service.
- The removal procedure is initiated by the submission to the Senate Executive Committee of a petition signed by no fewer than 25 voting members of the Faculty Senate. Upon receipt of such a petition, the Chair of the Senate Executive Committee will provide a copy of the petition immediately to the named representative. The Senate Executive Committee at its next scheduled meeting will place consideration of the petition on the agenda of the next regularly scheduled meeting of the Faculty Senate. The representative named in the petition will have the right to submit a written rebuttal of the petition to the Senate Executive Committee. The petition, and the rebuttal if one has been submitted, will be distributed with the meeting agenda to the members of the Faculty Senate.
- When the petition comes before the Faculty Senate, a representative of the petitioners and the responding faculty representative (or a designee selected by the responding faculty representative) will be provided an opportunity to address the Faculty Senate and to answer questions. The petition will fail unless approved by two-thirds or more of the voting members of the Faculty Senate present.
- If the petition is approved by vote of the Faculty Senate, the representative’s position will become vacant at the conclusion of that Senate meeting.
